These Terms & Conditions (“Terms”) govern your use of cerisiatatorin.com (the “Site”) and any purchase you make from it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

The Site is operated by Cerisia Ta’Torin, a sole trader based in Cornwall, United Kingdom.

About My Artwork

I sell original, handmade mixed-media artwork through this Site. Each piece is one of a kind, so once a piece is sold it is no longer available. Colours may appear slightly different on screen than in person, depending on your device’s display. Texture, layering, and other hand-finished details are part of the character of each piece and are not considered defects. Sizes and measurements are listed as accurately as possible but may vary slightly.

Orders and Payment

When you place an order, you are making an offer to buy the artwork at the listed price. I will confirm your order by email once it is accepted. Prices are shown in GBP (£) and include any applicable UK taxes unless stated otherwise; delivery costs are shown separately at checkout.

Payment is taken at the time of order through the Site’s secure checkout, processed by Squarespace Payments and/or Stripe/PayPal. I reserve the right to cancel or refuse an order, for example if a piece has already sold, if there is a pricing error, or if I suspect fraudulent activity, in which case you will receive a full refund.

Shipping and Delivery

I take care to package each artwork securely for transit. Estimated delivery times will be provided at checkout or in your order confirmation, but these are estimates only and not guaranteed. Risk in the artwork passes to you once it has been delivered to the address you provided.

International orders may be subject to customs duties or import taxes, which are the responsibility of the buyer.

If your artwork arrives damaged, please contact me within 48 hours of delivery, with photographs of the damage and packaging, so I can resolve this with you.

Returns, Refunds, and Cancellation

As a UK consumer buying online, you generally have the right to cancel your order within 14 days of receiving it, under the Consumer Contracts Regulations 2013, and to receive a refund. To cancel, please email me within this period, and return the artwork to me in its original condition within 14 days of telling me you wish to cancel. Return postage costs are your responsibility unless the item is faulty or not as described.

I want you to be happy with your purchase. If an artwork arrives faulty, damaged, or significantly different from its description, please contact me and I will offer a repair, replacement, or refund as appropriate, in line with your statutory rights under the Consumer Rights Act 2015.

Please note that because each piece is unique, refunds are not available simply for change of mind once the 14-day cancellation period has passed, except where the artwork is faulty.

Commissions

If you commission a custom piece of artwork, separate terms regarding pricing, deposits, timelines, and revisions will be agreed with you directly before work begins. Deposits for commissioned work are generally non-refundable once work has started, except where I am unable to complete the commission.

Intellectual Property

All images, designs, and content on this Site, including photographs of my artwork, are my copyright and may not be copied, reproduced, or used without my written permission. Purchasing a physical artwork does not transfer any copyright or reproduction rights in the image; I retain the right to reproduce, photograph, and display images of the artwork, including for portfolio, marketing, and exhibition purposes.

Newsletter and Marketing

If you sign up to my newsletter, you consent to receive marketing emails from me. You can unsubscribe at any time using the link in any email, or by contacting me directly. See my Privacy Policy for more on how I handle your information.

Use of the Site

You agree to use the Site only for lawful purposes and not to misuse it in any way that could damage, disable, or impair its functioning, or interfere with other users’ access to it.

Limitation of Liability

I provide the Site and its content on an “as is” basis. While I take reasonable care to keep information on the Site accurate and up to date, I do not guarantee that the Site will always be available, error-free, or uninterrupted. Nothing in these Terms limits or excludes my liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited or excluded.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

I may update these Terms from time to time, for example to reflect changes in the law or how I run my business. The “Last updated” date at the top of this page shows when it was last revised. Continuing to use the Site after changes are posted means you accept the updated Terms.
